Sub : OAS OFFICER CONVICTED IN VIGILANCE CASE FOR POSSESSION OF DISPROPORTIONATE ASSETS.
On 18.10.2017, the Hon’ble Special Judge, Vigilance, Cuttack convicted Sri Iswar Chandra Behera, OAS-1, Ex- Deputy Director, Consolidation, Bhadrak to undergo R.I for two years and to pay a fine of Rs.2,00,000/-, in default, to undergo R.I for further period of one year for possession of disproportionate assets to the tune of Rs. 21,91,337/-.
The gist of the case is that Cuttack Vigilance PS Case No. 08 dt. 29.03.2001 U/s 13(2) r/w 13(1) (e) P.C Act, 1988 was registered against Sri Iswar Chandra Behera, OAS-1, Ex- Deputy Director, Consolidation, Bhadrak on the allegation of possession of assets disproportionate to his known sources of income. On completion of investigation, charge sheet was submitted against him vide charge sheet No. 59 dt. 29.12.2003 U/s 13(2) r/w 13(1) (e) P.C Act, 1988 for possessing disproportionate assets amounting to Rs. 34,86,102.22/-.
Besides the trial of the D.A case, Confiscation Case No. 06/2012 was initiated against Sri Behera and his family members in the Court of Authorised Officer, Special Court, Cuttack, in which, the Learned Authorised Officer, Cuttack has also passed final order on 18.08.2017 for confiscation of the movable and immovable assets of Sri Behera and his family members to the tune of Rs.19,52,757.54.
Sri Jameswar Mishra, Public Prosecutor, Special Court, Cuttack conducted the case on behalf of the prosecution and Sri B.K.Nayak, Ex-Inspector of Police, Vigilance Cell, Cuttack investigated into the case.
